Intellectual property and restrictions on use of Content on the Site

Online Forums

You will not directly or indirectly place on the Site, such as in an online forum, any material that:
(a) breaches any law or regulation,
(b) is defamatory, libellous, threatening or offensive,
(c) infringes on the intellectual property rights of any third party or any rights of publicity or privacy,
(d) is obscene, pornographic or inflammatory or
(e) contains any virus, or other disabling feature.

Limitation of liability

Under no circumstances (including but not limited to any act or omission on the part of ahm) will ahm be liable for any indirect, incidental, special and/or consequential damages or loss of profits whatsoever which result from any use or access of, or any inability to use or access, the Site or any Content. To the fullest extent permitted by law, ahm's liability for breach of any implied warranty or condition which cannot be excluded is limited at the option of ahm to the following:

  • in the case of services supplied or offered by ahm
      (a) the supply of the services again, or
      (b) the payment of the cost of having services supplied again; and
  • in the case of goods supplied or offered by ahm,
    • (a) the replacement of the goods or the supply of equivalent goods,
      (b) the repair of such goods,
      (c) the payment of the cost of replacing the goods or acquiring equivalent goods, or
      (d) the payment of the cost of having the goods repaired.

    Purchasing Contact Lenses Online

    Protection of information
    We use the latest encryption technology to keep your personal information safe and we do not release it to any outside organisation. The information is stored on a secured server and is only used to process orders for contact lenses from our eyecare centres. This information will not be released to anyone other than those necessary to fulfill your order.

    Product Availability
    All orders received are subject to product availability. We will contact you if we cannot provide the product you have ordered. You will not be charged if the product is not in stock.

    Returns and Damage in Transit
    We guarantee the lenses you purchase will reach you in good condition. If they do not, or you are not completely satisfied with your purchase for some other reason, please return them to us (within 30 days of receipt) and we will replace them. Shipping and handling expenses are not subject to refund unless the lenses were damaged or we shipped you the wrong product. If so, we will absorb the costs to send you the correct item. This does not affect your statutory rights.

    Pricing
    We accept Visa, MasterCard, Bankcard, and American Express credit cards. Credit cards are handled by our secure server and charged the next business day after the order is filled. All prices are inclusive of GST where applicable.

    Where Contract Made
    Your contract with ahm commences when we have received your order.

    Online Services

    We will advise you from time to time of the transactions our Online Member Services will enable you to perform.

    In order to access our Online Member Services, you must be a member of the fund and be registered with a password.

    These services include but are not restricted to:

  • Online claiming.
  • Paying your premium by credit card.
  • Viewing previous transactions.
  • Viewing and/or editing membership details.

    Password
    Before you can access ahm online services, you will need to register your details, enter your membership number and password, according to the procedure set out on the membership page. You must also confirm that you have understood and agree to the Terms and Conditions of the Site.

    You must take reasonable care to keep your password confidential. If you decide to tell someone your Password, they become your Nominee and are subject to these Conditions of Use. We recommend that you do not record your Password. If you do so, you are responsible for keeping any records of your Password secure and protected, and separate from any records of your membership number.

    Transaction Limits
    Use of Online Services may be subject to transaction limits. These may be imposed by us or by other parties involved in any transaction. These include:

    • the maximum amounts which can be claimed online before claims are processed and benefits paid;
    • the maximum amounts which can be paid subject to financial year ancillary limits;
    • the maximum amounts for online credit card payments per transaction.

    Payments
    You are liable for all transactions carried out by you or by anyone carrying out a transaction with your authority or express or implied consent, regardless of when the transaction is processed to your account.

    You should check your statements and records carefully. If you believe a transaction is wrong or unauthorised you should contact us immediately.

    We will make all reasonable effort to ensure that the Site is available 24 hours a day, seven days a week. However, electronic services are subject to interruption or breakdown. Therefore, access to our web site is offered on an "as is" and "as available" basis only.

    Other

    This agreement will be governed by and construed in accordance with the laws of New South Wales, Australia. You irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of New South Wales. If any provision of this agreement is found to be invalid or unenforceable by a court of law, such invalidity or unenforceability will not affect the remainder of the agreement, which will continue in full force and effect.
